Mr. Molinari represented a 31-year-old man who slipped and fell on ice outside his place of employment in Union, New Jersey. Our client suffered a lumbar disc herniation at L5-S1 (lower back) that required pain management, an L5-S1 microdiscectomy surgery, and ultimately a lumbar fusion surgery. The defendants claimed that the property was owned by the employer and that our client was therefore barred from suing them under New Jersey’s worker’s compensation statutes. Mr. Molinari argued that there were multiple corporations that had been set up to avoid such claims and that these were nothing more than shell corporations. After losing their Summary Judgment motions on this issue, the defendants filed an interlocutory appeal that was also denied. In addition to recovering the $250,000 from the defendants, Mr. Molinari was able to have the entire worker’s compensation lien forgiven, and our client obtained additional money in the worker’s compensation claim.
