Mr. Elwood represented a 68-year-old man who was seriously injured, suffering numerous leg and foot fractures, when he mistakenly opened the lobby elevator door in his apartment building and stepped into the elevator shaft and fell down to the basement level. The elevator had lost power in the wake of Hurricane Sandy. However, the elevator which was inspected five days prior to the accident and six days after the accident, functioned normally. There was no known explanation for the malfunction of the door. Our client, who was blind, was not able to see that the elevator cab was not at the lobby level and mistakenly stepped into the elevator shaft suffering serious injuries. The case settled with all but one of the defendants for $700,000 Trial is pending against the one non-settling defendant.
