Kenneth Elwood represented an out-of-state casino patron who slipped and fell outside of the casino due to ice on a sidewalk. The woman had just stepped off of the bus which brought her to Atlantic City when she fell. Our client sustained a fractured knee (tibial plateau fracture), which required several surgeries to correct. The casino denied liability, producing photographs taken 2 hours after the fall, which showed a clear sidewalk. Ken was able to prove through eyewitness testimony that there was ice at the time of the fall. Ken also consulted with an expert engineer, and determined that where our client fell was located on an unsafe ramp which did not comply with applicable codes. The matter settled prior to trial at mediation for $300,000.
