John E. Molinari represented a 57 year old woman who was driving her car southbound on the outer roadway of the Garden State Parkway near milepost 112. In the interior southbound lanes of the Garden State Parkway, there was a collision between two vehicles that caused both vehicles to travel over the grassy median and strike the plaintiff’s vehicle on the other side of the roadway causing it to flip completely over back onto its tires and land in an adjacent ditch. The two drivers involved in the initial collision blamed each other for failing to stay in their own lane of travel and therefore causing the collision. One of the vehicles had a very high policy limit of insurance while the other vehicle did not.
Plaintiff was taken from the scene by ambulance to Riverview Medical Center suffering injuries to her head, jaw, neck and back. Her jaw injury was treated conservatively with an appliance while she underwent pain management care for her spinal injuries that included epidural injections to her neck and back, nerve root blocks to her neck and back, eventually a provocative discogram leading to a one level anterior cervical fusion.
Mr. Molinari obtained the services of an accident reconstructionist who attributed 100% of the fault in causing the accident to the driver with the very large insurance policy who was also blamed for the accident by the investigating police officer. The plaintiff’s case was consolidated with two other plaintiffs who were passengers in her car and at a settlement conference a few weeks before the scheduled Trial date, the plaintiff accepted the sum of $700,000.00 to settle her case, $100,000.00 which represented the full policy of insurance from the one driver and $600,000.00 from the other driver. All plaintiff’s medical bills were paid following successful PIP Arbitrations.
