After her nose was fractured by a falling refrigerator door, a 39-year-old Hackensack woman had nasal surgery. Six months later, she sought treatment for pain in her jaw from the surgeon who initially performed nasal surgery. He then recommended and performed temporomandibular joint surgery which worsened her condition.
The firm argued that this surgery is normally recommended as a last resort. This unnecessary surgery caused the woman to suffer ongoing facial pain. The jury awarded $1.5 million, as well as $250,000 to her husband for loss of marital companionship.
