In a case involving a four-year-old boy who was deprived of oxygen during labor resulting in a permanent brain injury, Blume Donnelly partner Carol Forte obtained a court-approved settlement in the amount of $3.95 million. In the case, it was claimed that the attending physician at a Middlesex County Hospital observed a depressed heart rate on a fetal monitor for 90 minutes but did not perform an emergency Caesarean section, and the child developed cerebral palsy and is blind. The defense expert testified the birth defects were caused by infection.
