Blume Donnelly principal Carol Forte recently obtained an $8 million settlement on behalf of a family where a client’s obstetrician failed to act after noticing the fetal heart rate was abnormally low and declining while the mother was in labor at a Monmouth County hospital. The obstetrician failed to mention the problem to her relief doctor, who also noticed the depressed heart rate but did not act. Their failure to perform a Caesarean section caused the child to be born with hypoxic ischemic encephalopathy, resulting in cerebral palsy. The child, now 9 years of age is blind, confined to a wheelchair and cannot speak or hold up his head.
