$650,000 Settlement for Brachial Plexus Injury During Birth / Erb’s Palsy
- Date: Summer 2012
- Attorney: David M. Fried
- Settlement: $650,000
- Practice Areas: Medical Malpractice, Labor & Delivery Malpractice, Shoulder Dystocia, Brachial Plexus Injury, Erb’s Palsy, Birth Injury
Mr. Fried represented a child whose arm was injured during birth when her shoulder became impacted behind her mother’s pubic bone (shoulder dystocia). There was evidence that the doctor pulled on the baby in order to free the stuck shoulder, which is not an appropriate maneuver to do when this situation occurs. As a result of this negligence, the doctor caused a brachial plexus nerve injury. Those nerves control arm, shoulder, wrist and hand movement. David’s client sustained a partial loss of function/use of her upper extremity.
