$3.5 Million Dollar Recovery for Failure to Diagnose Breast Cancer
- Date: Fall/Winter 2003
- Attorney: Carol Forte
- Settlement: $3.5 Million
- Practice Areas: Medical Malpractice, Failure to Diagnose Cancer, Failure to Provide Follow-up Mammogram, Breast Cancer
A $3.5 million settlement was obtained on behalf of a 28-year-old client whose doctors failed to timely diagnose her breast cancer. The patient, who had gone to a breast specialist because of complaints of a lump on her breast, was misdiagnosed as having cystic breast disease. As a result, her doctor failed to order appropriate testing, such as mammography and a biopsy. When the patient returned, the same mistake was made. When the patient returned at a later date with the same complaints, the diagnosis was made, but no before the disease had progressed to a more serious stage, significantly reducing her chances for a full recovery. Blume Donnelly partner, Carol Forte, represented the family.
