A surgeon is not only responsible for performing surgery correctly, he or she is also responsible for selecting the right surgery for the patient, as well as explaining the surgical options. In other words, a doctor has to give the patient information and choices so that the patient can make an informed decision about his or her own healthcare. The firm represented a woman who had a bunion that she wanted addressed. There were several appropriate procedures but her doctor simply told her that the bunion would be surgically repaired. The doctor chose a procedure that involved the removal of a joint, which carried a high rate of failure. Our client was unaware that there were alternative procedures available or that the surgery the doctor chose was going to involve the removal of a joint. The surgical procedure failed and our client was left with a painful and deformed foot. The case settled before trial.
