Blume Donnelly partner John Molinari represented a truck driver who was delivering blasting equipment to a construction site and had his foot crushed by the outrigger of a 20-ton excavating machine. The crush injury resulted in the amputation of his middle toe. Mr. Molinari successfully argued that the “borrowed servant” rule did not apply which would have resulted in the dismissal of this case. The defense also argued that the plaintiff should have heard the outrigger leg being lowered and therefore that he was also negligent. John Molinari settled the case for $325,000.
