The firm secured a settlement having a present value of $1,750,000 on behalf of a 49-year-old truck driver in training who lost his arm during on-the-job training. His mentor, who was driving the truck, claimed that our client ran behind the truck, despite his instructions, and blamed our client for the accident. Any claim against the driver was barred by Workers’ Compensation immunity. The claim was against a third individual who undertook to guide the truck backing up, and, in so doing, caused the truck to back into our client, whose arm was caught between the trailer and a cement post. The defendant denied guiding/helping to back up the truck. The client’s right arm was crushed and doctors were forced to amputate it above the elbow.
