John Molinari represented a 43 year old female executive who was leaving her Jersey City office building in the evening when she slipped and fell on an ice patch that had not been cleared or salted in front of the building. The lawsuit blamed both the building owner and the snow removal company with whom they had a contract. Evidence showed that it has last snowed early that morning and there was only minimal accumulation. Both defendants denied that they had cleared the snow but they produced a photograph allegedly taken just after the plaintiff fell showing that the area was well maintained.
Plaintiff suffered a trimalleolar fracture to her right ankle and had to undergo two surgical procedures to repair it. She also fractured her right elbow that fortunately healed without surgery. The case settled at the first trial call following a conference with the court with each defendant paying half of the total amount.
