He fell down the interior stairs causing him to severely fracture his left ankle requiring two surgeries. The defendant questioned that there was any defect with the stairs despite plaintiff’s expert report outlining the defects. Defendant even filed a motion to dismiss plaintiff’s case for failing to establish any defect. Once that motion was denied the claim was settled for $375,000.00.
