$1 Million Jury Verdict for Wrongful Birth

Kenneth W. Elwood & Mitchell J. Makowicz represented the family of a child born with Congenital Adrenal Hyperplasia. A jury awarded an aggregate verdict of $1 million dollars to the parents for the “wrongful birth” of that child, due to prenatal testing errors resulting in a failure to diagnose the condition. The jury allocated liability 75% to the hospital, and 25% to a lab technician. The jury awarded $625,000 to the child for extraordinary medical expenses and $375,000 to the parents for their emotional distress.
